MAXIMS GLOBAL is a small private law publishing company
based in the United Kingdom providing publications in two very distinct
areas of law.
Maxims Global Ltd - Company Formation
The inspiration for forming Maxims Global Ltd came from the evolution of our legal process and the systems within the United Kingdom of the Common Law legal system and Equity. Equity based its persona within its famous "Maxims of Equity" Lord Cowper in 1705; latterly revived by Lord Hodson in 1965; gave as detailed an analysis of the concept of Equity, as is available to explain its nature.
"Now equity is no part of the law, but a moral virtue, which qualifies, moderates and reforms the rigour, hardness and edge of the law, and is a universal truth, it does also assist the law where it is defective and weak in the constitution (which is the life of the law) and defends the law from crafty evasions, delusions, and new subtitles, invented and contrived to evade and delude the Common Law, whereby such as have undoubted right are made remediless; and this is the office of equity, to support and protect the common law from shifts and crafty contrivances against the justice of the law. Equity therefore does not destroy the law, nor create it, but assist it."
Equity's role was thus to supplement the Common Law and correct its deficiencies. The very concepts of Equity still exist in our Legal System today, as there are still Equitable discretionary remedies in law alongside Common Law remedies. The two systems have long since merged their Administration through the Judicature Acts of 1873-1875. The Supreme Court must give effect to both legal and equitable rights and remedies, but it is still the fact today that where there is a conflict between the rules of Common Law and Equity in the same issue, Equity prevails. Thus to return to the "Maxims of Equity", where legal principles were propounded in the form of Maxims applicable to the Legal system. It is a marvellous concept that Maxims are applied to many legal issues throughout the globe; it is this spirit inherent in the "Maxims of Equity" that forms the basis and inspiration for the launch of this Law Publishing Company Maxims Global Ltd.
